• Plaintiff contended that a loan application was submitted on her behalf by her assistant.  Further, she contended that there were sufficient red flags on the application to warrant a due diligence inquiry by the lender.  Plaintiff contended that the lender failed to make inquiry.  In addition, Plaintiff contended that the loan secured by her real property was a consumer loan in violation of law.
